The Constitutional Court cuts the knot: associations of co-owners are companies. But not for long?

In its ruling no. 93/2023 of 15 June 2023, the Constitutional Court held that the designation of associations of co-owners (hereafter: ACO) as companies within the meaning of article I.1, 1° Code of Economic Law, as well as the consequences this designation brings are not discriminatory towards natural persons responsible for the management and maintenance of buildings.
