In issue 3 (year 2016) of the Tijdschrift voor Aannemingsrecht [Journal for Contracting Law] Marco Schoups and Jan De Leyn discuss the recent case-law of the Council of State on the signing of offers for public procurement contracts. 

The authors show that, in its case-law, the Council of State has generally been very tough on tenderers who did not (validly) sign their tender. However, three recent decisions suggest that the Council is becoming more flexible on a number of points where it had earlier been quite strict: RvS 31 March 2014, no. 226.982; RvS 22 March 2016, no. 234.189 and RvS 6 August 2016, no. 232.024. It remains to be seen whether and to what extent the Council of State will continue down this particular path in its case-law.
