Schoups publishes two notes in the Tijdschrift voor Bouwrecht en Onroerend Goed

In September 2016 the fourth issue of year 14 of the Tijdschrift voor Bouwrecht en Onroerend Goed [("TBO"), the Journal for Construction Law and Real Property] has been published, containing two notes from the Schoups firm.

In their note under the Court of Cassation´s decision of 10 September 2015, Marco Schoups and Jan De Leyn examine the reporting duties within the framework of complaints and petitions by the contractor in a public procurement contract context. They analyse whether and how these reporting duties have been tightened up in the recent regulations compared to the rules that applied earlier.

Carlo Cardone has written a note under the judgement of the Dutch-language Commercial Court of Brussels of 18 December 2015, concerning the question  whether or not an acceptance can be deduced from a late verification by a contracting authority of a final statement. In the note, the author briefly discusses the different positions taken on this in the case-law.
