Update on late-payment interest for public procurement contracts (1)

Public procurement contracts awarded prior to 8 August 2002 : In accordance with article 15, § 4 AAV [algemene aankoopvoorwaarden = General Purchase Conditions], the interest rate to be applied as of 1 October 2014 for late-payment interest amounts to 1.80 % for public procurement contracts published as of 1 May 1997 and public procurement contracts for which, in the absence of an obligation to publish an announcement, there was an invitation to submit a tender or a request for participation as of that date. The same interest rate applies as of 1 October 2014 to public procurement contracts whose execution is subject to article 15, § 4, of the Ministerial Decree of 10 August 1977 and which were published as of 1 January 1981 or those for which, in the absence of an obligation to publish an announcement, there is an invitation to submit a tender or a candidacy as of that date. Public procurement contracts awarded between 8 August 2002 and 15 March 2013 : In accordance with article 15, § 4, AAV, the following interest rates apply for contracts awarded between 8 August 2002 and 15 March 2013:

• July to December 2014: 7.50%
• January to June 2014: 7.50%
• July to December 2013: 7.50%
• January to June 2013: 8%
• July to December 2012: 8%
• January to June 2012: 8 %
• July to December 2011: 8.50 %
• January to June 2011: 8 %
• July to December 2010: 8 %
• January to June 2010: 8 %
• July to December 2009: 8 %
• January to June 2009: 9.50 %
• July to December 2008: 11.50 %
• January to June 2008: 11.50 %
• July to December 2007: 11.50 %
• January to June 2007: 11 %
• July to December 2006: 10 %
• January to June 2006: 9.50 %
• July to December 2005: 9.50 %
• January to June 2005: 9.50 %
• July to December 2004: 9.50 %
• January to June 2004: 9.50 %
• July to December 2003: 9.50 %
• January to June 2003: 10 %
• August to December 2002 : 10.50 %

Public procurement contracts awarded as of 16 March 2013 : In accordance with article 69 of the Royal Decree of 14 January 2013 defining the general rules for implementation of public procurement contracts and concessions for public works, the following interest rates apply for contracts awarded as of 16 March 2013:

• July to December 2014:  8.50%
• January to June 2014: 8.50%
• July to December 2013: 8.50%
• 16 March to June 2013: 9%
