Publication new Royal Decree on the Award of Public Procurement Contracts in the Belgian Official Journal

Today the new Royal Decree of 18 April 2017 on the Award of Public Procurement Contracts in the classic sectors has been published. The published text can be consulted through the following link: http://www.ejustice.just.fgov.be/cgi/summary.pl

This new Royal Decree on the Award of Public Procurement Contracts sets to enter into force on the 30th of June 2017.

However, the whole new legal framework concerning Public Procurement Contracts will enter into simultaneously. This means that the Belgian regulator aims that the other implementation decrees, which are not yet published, also will enter into force on the 30th of June 2017.       

On the 28th of April 2017, the Federal Government approved the draft of the amended Royal Decree on the Execution of Public Procurement Contracts in second reading. This draft can be consulted through the following link: http://www.publicprocurement.be/nl/documents (Dutch) or  http://www.publicprocurement.be/fr/documents (French).

This draft of the amended Royal Decree determining the general rules of execution of public procurement contracts also sets to enter into force on the 30th of June 2017. It is to be expected that the final version of the amended Royal Decree determining the general rules of execution of public procurement contracts will be published in the Belgian Official Journal soon.

Besides the above-mentioned implementation decrees, the following implementation decrees are still in the "pipeline":

• the award of public procurement contracts in the special sectors;
• the rules concerning the award and the general rules of execution for concession contracts.
