Presence registration - inspectorate applying tolerance policy until December 31st

We recently reminded you that the sanctions on the mandatory electronic presence registration entered into effect on 1 October 2014. The legislation itself has already been in force since 1 April 2014, but there was a transitional period regarding the sanctions until 30 September 2014.   Perhaps due to the many unclear aspects and questions from the sector, the inspection services have now announced on the NSSO’s “Checkinatwork” website that they will be applying a “tolerance policy” until the end of December 2014.     The text posted on the website reads as follows (translation):   “The inspection services responsible for enforcing compliance with the legal provisions on the presence registration have decided to apply a tolerance policy with regard to sanctions until the end of December 2014. As of 1 January 2015 these services will, with a view to the application of sanctions (which legally have applied since 1 October 2014), draw up official reports for violation of the presence registration in appropriate cases. During the period from 1 October to 31 December 2014 the emphasis will therefore continue to be placed on providing the companies with information."   Contractors thus have another two months to bring themselves into compliance within the framework of this legislation on the mandatory presence registration. And be sure to remember that your subcontracting contracts will have to be adapted for this as well.
