On Thursday, October 25th, Marco Schoups and Jelena Adriaenssens are speaking at the National Tender Day.

The National Tender Day is the largest event for the public sector in Belgium. Each year the most important players come together to review and analyse all the latest developments in the sector.

The legal framework is also updated annually on the basis of the highest-profile decisions issued by the Council of State.

Schoups is delighted to be participating with a presentation on an important aspect of this legal framework.

Marco Schoups and Jelena Adriaenssens will speak in the legal hall about Public Real Estate transactions (specifically, public procurement law versus the principle of equality and transparency).

The following main topics will be addressed:  

• Do public real estate transactions escape application of the public procurement contracts legislation and, if so, under what conditions?
• How is the recent case-law of the European Court of Justice and the Council of State evolving in terms of the scope of application of the public procurement contracts legislation?
• When must a transparent market survey be organised, and in what form?
• Are there exceptions to the applicability of the principle of equality and transparency, and can a public real estate transaction also be concluded privately?
