Nuisance premiums for small companies since 1 July 2017 for public works

Private Construction Law

12 October 2017

For small companies that have fewer than ten employees, since the entry into effect of the Nuisance Premium Decree on 1 July 2017 it is possible to apply for a premium in cases where they are seriously inconvenienced by the performance of public works. [1]

This is a premium of 2,000.00 EUR that can be applied for prior to the start of the public works and which can be granted at most once a year and a single time per nuisance period.

In addition, there is another nuisance premium of 80.00 EUR per closing day that can be granted as of the 8th or the 22nd closing day depending on whether this is a separate or additional nuisance premium. Per company, a maximum of 365 closing days per nuisance period can be compensated.

The companies that qualify for these premiums will generally be contacted by the Innovation and Entrepreneurship Agency. If your company has not been contacted by the Innovation and Entrepreneurship Agency and you nevertheless believe that you could be entitled to these nuisance premiums, you can contact the office. We can check whether you qualify for the nuisance premiums and help you apply for it.
