Limosa report expanded as of 1 October 2017

In an earlier newsflash we focused on how the rules on posting employees are being made stricter. Within that context, the Limosa report is now also being expanded. Foreign employers who temporarily post employees to come and work in Belgium will first have to file such a Limosa report.  

As of 1 October 2017, a number of additional pieces of data must be contained in the Limosa report, including the data on the contact person:

  • the nature of the services performed within the framework of the posting in Belgium;
  • in the event of temporary agency work, the authorisation number of the foreign temporary work agency, if this authorisation is prescribed;
  • data for the PDOK [= Patronale Dienst voor Organisatie en Kontrole van de bestaanszekerheidsstelsels = employers´ office for the organisation and supervision of social security systems]: the mention of whether or not the blue-collar worker, for the period of the employment in Belgium, in application of the regulations to which his employer is subject in the country of establishment, enjoys benefits that are comparable to the loyalty or bad-weather stamps (only for work that falls within the scope of the Joint Committee for the building industry no. 124);
  • the identification data and the contact information of the contact person:

- his last name, first names and date of birth. In the event that the contact person possesses a Belgian social security identification number, that number suffices;

- the capacity in which this contact person acts;

- his physical and electronic addresses, as well as a telephone number at which he can be contacted.

Prior to putting the employees posted in Belgium to work, the foreign employer must designate a "contact person". This person´s mission is to provide the social documents necessary for verification to the inspection services and to handle the communication with the inspection services. The contact person can be the foreign employer, an employee of the employer or an external service provider.
