Justice Committee has approved books 1 and 5 (new) of the Civil Code

On 22 March 2022, the Justice Committee approved books 1 (General provisions) and 5 (Law of obligations) of the (new) Civil Code. In this way, another step has been taken towards the new contract law.

With these new books, current case law and the existing general principles with a number of innovations are incorporated into the legislation. For example, the new legislation would regulate the conflict of interest in the context of representation, which may be important in the conclusion of the contract. Furthermore, a number of post-contractual commitments are codified. Also useful is the possible requalification of the contract by the court.

An important novelty for the construction sector is the determination of the imprevision doctrine for private contracts. This was not regulated under the old Civil Code. The draft provides for a regulation of this.

The new contract law would normally be voted on definitively in plenary after the Easter holidays. The firm will host a webinar on this important evolution.
