Additional temporary possibility for procurers to grant an advance of up to 20 per cent of the original contract amount in public procurement entered into force

On 19 December 2022, the "Royal Decree of 29 November 2022 on the granting of an advance in public procurement due to the economic situation caused by the war in Ukraine" entered into force. As already explained in our newsletter of 20 November 2022, the federal government thereby provides for an additional temporary possibility for procurers to grant an advance and this both for public contracts already in execution and those yet to be launched, given the significant price increases for numerous raw materials, semi-finished and finished products following the war in Ukraine.
